JUDGEMENT

(1.) The second respondent by a composite order dated 23rd May, 2003, I erected transfer of ten officers including the appellant and the second respondent. While the appellant, who was working as Managing Director, Ganganagar Kendriya Sahkari Bank, Sriganganagar was transferred as Project Director, Monitoring, Head Quarters, Cooperative Societies, Jaipur, the first respondent was transferred and posted as the Managing Director, Ganganagar Kendriya Sahkari Bank. Pursuant to the aforesaid order of the second respondent, the first respondent took over the charge of the post of Managing Director of the Bank on 24th May, 2003. Subsequently, on 27th May, 2003 the appellant filed a writ petition In this Court challenging the order 10 at his transfer dated 23rd May, 2003. In the writ petition no interim order was granted.

On 31st May, 2003 the appellant filed an appeal before the Rajasthan Civil Services Appellate Tribunal, Jaipur, against the order dated 23rd May, 2003, without disclosing the fact that he had already filed a writ petition in this Court for the same relief. On 2nd June, 2003, the Tribunal stayed the order of transfer dated 23rd May, 2003. Having obtained the interim order, the appellant withdrew the writ petition on 5th June, 2003.

(3.) The first respondent as well as the State filed separate writ petitions against the order of Tribunal dated 2nd June, 2003. The learned Single Judge, by an interim order, stayed the operation of the impugned order passed by the Tribunal. The appellant feeling aggrieved by the order of the learned Single Judge, has filed the instant appeal.
