PHOOL CHAND & ANR. Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) In this case, the allegation in the FIR is that Kalyan, Kedar, Ramesh, Hari Kishan and Lal Chand pressed the neck of Radheyshyam after sitting on chest and these people man handled giving injuries by fict and foot. No specific allegation has been levelled against the two persons (petitioners) in a case where the accused died as a result of strangulation and there are no multiple external injuries and no overt act is attributed. I am inclined to grant the indulgence as 10 persons have already been arrested and have been released on bail in this case.

(2.) The SHO/Arresting Officer/Investigating Officer, Police Station Niwai (Tonk) in FIR No. 115/92 is therefore, directed that in the event of arrest of petitioner, Phool Chand and Ram Bilas they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs. 2,000.00 (Rs. Two Thousand) with one surety in the like amount to his satisfaction, on the following conditions:-
