JUDGEMENT

(1.) There is a previous litigation between the parties and specific overt-act against the accused has been attributed after more than couple of months of the incident. Besides this, there is no injury by sharp edged weapon as alleged in the F.I.R. The accused is serving as Asstt. Secretary in the Gram-panchayat and is also Extra Departmental Agent of the post office Nagal Govind. In this view of the matter I am inclined to grant indulgence to the accused-petitioner.

(2.) The SHO/Arresting Officer/Investigating Officer, police station Govindgar (Jaipur) in F.I.R. No. 153/1991, is therefore, directed that in the event of arrest of the petitioner. Gulab Singh he shall be released on bail, provided he furnishes a personal bond in the sum of Rs. 2000.00 with one surety in the like amount to his satisfaction on the following conditions:-
