JUDGEMENT

(1.) Heard. Case diary perused. As per the prosecution case itself the accusation of setting fire to ...[VERNACULAR TEXT OMITTED]... is against the co-accused, Banwari and not against the petitioner. In my view, the petitioner should be given the benefit of pre-arrest bail u/s 438 Crimial P.C.

(2.) The SHO/Arresting Officer/Investigating Officer, Police station Nawalgarh, Dist. Jhunjhunu in FIR No. 61/92 is therefore, directed that in the event of petitioner Sanwarmal S/o Sh. Sultanpuri he be released on bail, provided he furnishes a personal bond in the sum of Rs. 5,000.00 (Rupees Five Thousand) with one surety in the like amount to his satisfaction, on the following conditions:-
