JUDGEMENT

(1.) The present bail application has been filed under Sec. 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.135/2018, Police Station Pur, District Bhilwara, for the offences punishable under Ss. 8/15 & 29 of NDPS Act.

(2.) Counsel for the petitioner submits that the recovery of contraband was made from the co-accused Parasmal and after trial of the case, Parasmal was convicted under provisions of Sec. 8/15 of NDPS Act and sentenced for about three years. Counsel further submits that the present petitioner was implicated in this case with the aid of Sec. 29 of NDPS Act. He furthermore, submits that similarly situated co-accused Narayanlal Regar has already been enlarged on bail by the Co-ordinate Bench of this Court and the case of the present petitioner is similar to that of co-accused. The accused-petitioner is in judicial custody and the trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioner.

(3.) Learned Public Prosecutor vehemently opposed the bail application.
