GANPATRAM Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application under Sec. 439 Cr.P.C. is laid by petitioner in connection with an FIR No.105/2022 registered at Police Station Shastrinagar, District Jodhpur, wherein he is charged for offences punishable under Ss. 8/15 and 8/18, of NDPS Act.

(2.) Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He also submits that recovered contraband is below commercial quantity and he is in judicial custody since considerable time. The conclusion of the trial will take time, therefore, benefit of bail may be granted to the petitioner.

(3.) Learned Public Prosecutor opposed the bail application and submitted that petitioner is a habitual offender.
