JUDGEMENT

(1.) This writ petition has been filed by the petitioner aggrieved against the order dtd. 20/7/2021 (Annex. 3), whereby, the respondent No. 2 has been selected for the post of Medical Officer for appointment on contractual basis in ART Centre situated at JLN District Government Hospital, Nagaur pursuant to the advertisement dtd. 8/2/2021.

It is inter alia submitted in the writ petition that an advertisement dtd. 8/2/2021 (Annex. 1) was issued by the Principal Medical Officer inter alia indicating the requirement of two Medical Officers and inviting applications from eligible candidates for appointment on contractual basis. Last date of submission of applications was 22/2/2021 upto 5.00 pm and it was indicated that the applications will be received by registered post only.

It is also indicated that though the respondents received in all 09 applications, only 03 applications were received upto 22/2/2021 and rest all the applications were received on 23/2/2021, which is evident from the details of candidates published by the respondents (Annex. 2). From the list it is apparent that the application form of respondent No. 2, a selected candidate, was received on 23/2/2021. It is indicated that the interviews were held and the respondents published the result on 20/7/2021, wherein, the respondent No. 2 has been shown as selected at No. 1 and the petitioner was placed in the waiting list.
