JUDGEMENT

(1.) Heard learned Public Prosecutor, learned counsel for the respondents and perused the judgment impugned.

(2.) This Court is of the opinion that there are valid and substantial grounds for grant of leave to the appellant applicant State of Rajasthan for filing an appeal against the acquittal of the respondents vide impugned judgment.

(3.) Accordingly, the application for grant of leave to appeal is allowed. The memo of leave to appeal be treated as an appeal and it be registered as such. Amended cause title be filed within two weeks. The respondents be summoned through bailable warrants in the sum of Rs.30,000.00. The respondents accused, who are duly represented, shall appear before the Registrar Judicial, Rajasthan High Court, Jodhpur within next 45 days and furnish a personal bond in the sum of Rs.30,000.00 and a surety in the like amount to his satisfaction.
