JUDGEMENT

(1.) Learned Government Counsel fairly and frankly conceded that controversy involved in the present matter is covered by judgment delivered by this Court in Laxman Singh V/s State of Rajasthan and Ors.(S.B. CWP No. 1423/98), decided on 13 th August, 2002, which has been affirmed by Division Bench of this Court vide judgment dated 8 th May, 2003 delivered in D.B. Civil Special Appeal No. 377/2003(DRJ). He, therefore, submits that this appeal may be dismissed in view of the above referred judgment.

(2.) In view of statement of learned counsel for the appellant, this appeal is dismissed being covered by judgment delivered in the case of Laxman Singh V/s State of Rajasthan and Ors.. Stay application also stands dismissed.
