(2.) THE present appeal is directed against the judgment and decree dtd.12.05.2006 passed by the learned Additional District Judge, Nimbahera in appeal No.11/2002 � Legal Heirs Bakhtawar vs. Smt. Kasturibai & another by which the learned Additional District Judge, Nimbahera dismissed the appeal and upheld the judgment and decree dtd.11.10.2002 passed by the Civil Judge (Sr. Division), Nimbahera in Civil Original Suit No.128/1993 � Legal Heirs of Shri Bakhtawar vs. Smt. Kasturibai and another whereby the learned trial Court dismissed the suit for declaration and permanent injunction filed by the plaintiffs who are legal representatives of late Shri Bakhwtawar.
