JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) THE present intra Court appeal was preferred on 23.12.1999, challenging order dated 27.05.1996 passed by the Single Bench in S.B. Civil Writ Petition No. 816/1981 i.e. with the delay of 1295 days.

(3.) FROM the above discussions, it is clear that the appellant has failed to furnish satisfactory explanation for delay of more than three years in filing the appeal. So far another submission regarding setting aside the order passed in the case of S.B. Civil Writ Petition No. 486/1982, Mod Singh and Others V. State of Rajasthan and Others(supra) is concerned, there is no merit in the contention of learned counsel for the appellant in view of the judgment delivered by the Hon'ble Apex Court in the case of S.S. Balu and Another Vs. State of Kerala and Others(supra).
