(1.) Heard learned Counsel for the parties and carefully perused the file. Learned Counsel for the appellant has made a very short submission and contended that the Tribunal passed the award on 3rd December, 2005 and directed the respondents to pay the amount of compensation within a period of 30 days, failing which the Tribunal allowed interest @ 6% per annum, to be paid thereon from that date. He has submitted that the appellant may be allowed to receive the interest from the date of filing of the claim petition till the amount is actually realized.
(2.) Mst. Chitra Goyal, learned Counsel appearing for the Insurance Company does not object to it.
(3.) Having heard the learned Counsel for the parties, it is needless to say that the amount of interest is unfailingly ordered to be paid from the date of filing the claim petition in almost all the claim petitions by the Tribunals as also the appellate Courts. The instant case cannot be an exception to it. Hence, with the consent of the learned Counsel for the respondent-Insurance Company, I feel just and proper to allow the interest to be paid from the date of filing of the claim petition.
