(1.) A letter sent by Smt. Rukma Devi, has been treated as a letter petition by this Court. Vide order order 4.1.2012, this Court had appointed Mr. Vijay Raj Purohit, as amicus curiae to argue on behalf of the petitioner, Smt. Rukma Devi.
(2.) Mr.Vijay Raj Purohit, submits that Smt. Rukma Devi's husband, Dala Ram was convicted for offence under Section 302 IPC by the Additional Sessions Judge (Fast Track), Nagaur vide judgment dated 25.2.2003. Since, he is eligible for being transferred to Open Air Camp, he was transferred to Open Air Camp, Jodhpur vide order dated 9.12.2010. However, the petitioner, the wife finds it extremely difficult to travel from Nagaur to Jodhpur in order to meet her husband. Hence, her prayer that her husband should be shifted from Open Air Camp, Mandore, Jodhpur to Open Air Camp, Nagaur.
(3.) On the other hand, the learned Public Prosecutor, has contended that the power of transfering a convicted prisoner from one Open Air Camp to another lies with the Director General Prisons, Rajasthan, Jaipur. However, so far neither the petitioner nor Dala Ram has submitted an application before the D.G.P. for transferring him from one Open Air Camp to another. He assures this Court that in case the application were filed either by the petitioner, or by Dala Ram, the same shall be considered sympathetically by the D.G.P.
