(1.) This criminal leave to appeal has been filed by the applicant challenging the order impugned dated 26.3.2010 passed by Special Judicial Magistrate (N.I.Act Cases) No.2, Jodhpur (for short 'the trial court' hereinafter) in Cr. Case No.5573/2009, whereby the trial court while dismissing the complaint filed by the applicant-complainant, has acquitted the accused-respondent for the offences under section 138 of the Negotiable Instruments Act (for short 'the NI Act' hereinafter) in accordance with the provisions of section 256 CrPC.
(2.) Having heard learned counsel for the applicantcomplainant, Public Prosecutor for the State and the counsel appearing for the accused-respondent and having perused the order impugned, I am of the opinion that this is a fit case to grant leave to appeal to this Court.
(3.) Accordingly, the leave to appeal is granted. Memo of leave to appeal be treated as memo of appeal. Appeal be registered on regular number.
