(1.) Matter comes up on IA No. 4669 dated 28.5.2012 seeking disposing of Instant criminal misc. petition filed under Sec. 482 Cr.PC. for quashment of order dated 3.11.2010 passed by Addl. Civil Judge (JD) and JM, Roopwas, Bharatpur as well as proceedings Initiated therein.

Learned counsel for petitioner submits that divorce petition filed by the petitioner under Sec. 13-B of Hindu Marriage Act, 1955 has been decided on mutual consent and on the basis of compromise taken place between the parties. It is submitted that decree of divorce has also been passed and marriage has been dissolved from the date of passing of decree of divorce. It is further submitted that when the parties have amicably settled their dispute out of Court, no fruitful purpose would be served by keeping the matter alive for trial and, therefore, prayed that this application as also petition may be allowed in view of compromise arrived at between the parties in the light of judgment of Honourable Apex Court in Manoj Sharma Vs. State and ors., (2008) 16 SCC 1.
(3.) Learned Public Prosecutor and counsel appearing on behalf of complainant-respondent no. 2 corroborate the fact of arriving at compromise.
