(1.) THE learned counsel Mr. H.S. Bishnoi appears for the respondents. At request, the matter has been considered finally at this stage itself. The learned counsel for the parties submit ad idem that the issue involved in this writ petition stands covered by the decisions rendered by this Court in the past, including that by a learned Single Judge in the case of Surajmal Jat & Ors. Vs. State & Anr. :, 2010 WLC (UC) 157; and by a Division Bench of this Court in the intra -court appeal, SAW No. 05019/2011 : The State of Rajasthan Vs. Suraj Mal & Ors., decided on 01.08.2011. The learned counsel further point out that in a similar petition, being CWP No. 10695/2010 : Bhawana Shankha & Ors. Vs. State of Rajasthan & Anr., decided on 10.02.2012, a co -ordinate Bench of this Court has passed the following order: -
(2.) THE position aforesaid, it is submitted, applies to the present petition too. In view of the above, this writ petition is partly allowed to the extent and in the manner indicated in the aforesaid decisions and in the same terms. No costs.
