(1.) A copy of the writ petition has been supplied to learned Deputy Government Advocate.
(2.) AT the request of learned counsel for the parties, arguments were heard and writ petition is being disposed off finally.
(3.) SUBMISSION of learned counsel for the petitioner is that on 27th July, 2010, a jail punishment was awarded to the petitioner, therefore, his case was rejected for sending him to open air camp. The petitioner earlier preferred D.B. Civil Writ Petition No. 1734/2012 to transfer him to open air camp. Since two years had not expired in view of Rule 3(g) of the Rajasthan Prisoners Open Air Camp Rules, 1972, therefore, the petitioner made a prayer to allow him to withdraw the writ petition. Prayer of the petitioner was allowed and his writ petition was dismissed as withdrawn at that stage vide order dated 27th February, 2012. Since a period of two years has now expired after awarding jail punishment, therefore, the petitioner is now eligible for consideration of his case to transfer him to open air camp.
