JUDGEMENT

(1.) AT the instance of one Shri Babu Lal son of Shri Achal Das, a case was registered against the petitioner on 10.10.1997 at Police Station, Dhorimanna for the offence punishable under Sections 457 and 354 IPC.

(2.) AFTER regular investigation, a police report was filed before the competent court and a charge for the offence punishable under Sections 457 and 354 IPC was framed. On denial of the same, regular trial commenced and during the course of trial, learned trial court recorded the statements of eight witnesses in support of prosecution and also examined documents Exhibit-P/1 to Exhibit-P/5. An opportunity was given to the petitioner to explain the adverse circumstances available in prosecution evidence, wherein he in general terms stated that the entire evidence is false. Learned trial court by relying upon the statement of PW-1 Smt. Dhami and PW-2 Babu Das held the petitioner guilty for the offence punishable under Sections 457 and 354 IPC. Accordingly, he was convicted for the same and sentenced as under :-

(3.) OFFENCE UNDER SECTION 354 IPC : Three months' Simple Imprisonment with a fine of Rs.100.00 and in default of payment of fine to further undergo fifteen days additional simple imprisonment. Both the sentences were directed to run concurrently.
