JUDGEMENT

(1.) HEARD learned counsel for the parties. In this writ petition, the petitioner has prayed for direction to the respondents to consider his candidature for appointment on the post of Lab Boy, for which, petitioner applied for in pursuance of advertisement issued by the respondents on 04.09.2011

LEARNED counsel for the petitioner submits that without following the process of law respondents straightaway held the examination for the post of Lab Boy and when this fact came in the knowledge of the petitioner, the petitioner contacted the University and found that examination has been held without issuing admission letter to the petitioner even though he is eligible.

PER contra learned counsel appearing on behalf of University submits that the allegation levelled by the petitioner in the writ petition is totally baseless because Roll No. 728 was allotted to him and admission letter was also issued to the petitioner which is evident from the document EMS Speed Post Daily Report, of the Department of Posts, India, Bikaner dt. 12.01.2012 as Annexure -R/1, in which, petitioner's name is shown at Serial No. 106, but petitioner did not appear, therefore, it cannot be said that petitioner has been denied opportunity illegally by the respondents, therefore, now petitioner cannot claim any right of consideration because the petitioner has failed to avail opportunity inspite of sending admission letter through speed post.
