(1.) A letter sent by Jagan Nath, a convicted prisoner of Central Jail Jodhpur, has been treated as a letter petition. Vide order dated 23.01.2012, Ms. Anita Gehlot was appointed as amicus curaie to represent the case of the petitioner.
(2.) Ms. Anita Gehlot has submitted that out of a total sentence of ten years, the petitioner has already served five years, for months and thirteen days. Although he is eligible to be released on parole for twenty days, his case is not being considered by the Director General (Prisons), Jaipur.

On the other hand, the learned Public Prosecutor has submitted that while the reports of the Superintendent of Police, Jodhpur and the District Magistrate, Chittorgarh, Social Welfare Department, Chittorgarh and Narcotics Bureau Chittorgarh have been received, reports of the District Magistrate, Jodhpur, Social Welfare Department, Jodhpur and Narcotics Bureau, Jodhpur are yet to be received. In absence of these reports, the case of the petitioner is still pending before the Director General (Prisons). He informs this court as soon as the reports are received, his case shall be considered by the DGP. It is the duty of the respondent to ensure that the reports are received on time so that the case of the convicted prisoner can be considered for grant of parole. Therefore, this Court directs the District Magistrate, Jodhpur, Social Welfare Department, Jodhpur and Narcotics Bureau, Jodhpur to submit their reports with regard to the conduct of the petitioner within a period of three weeks before the Director General (Prisoners), Jaipur. The Director General (Prisons), Jaipur is directed to decide the case of the petitioner within a period of one week thereafter.
