AT the outset, the learned counsel for respondents point out that the issue with regard to acquisition of land for establishment of SEZ has already been decided by this court in SBCWP No. 6898/2006, Gautam Estate Pvt. Ltd. Vs. State of Rajasthan, on 26 - 9 -2008. Counsel further points out that the order dated 26 -9 -2008 passed in SBCWP No. 6898/2006 has attained finality, as the DB Special Appeal No. 1648/2008 filed there against has been dismissed as withdrawn. It has been thus submitted that the present case be decided accordingly. Counsel for the petitioner admits to the submissions. It has also been brought to the notice of this court that over 80% of the land acquired for the SEZ at Jaipur has already been taken possession of and the whole project is at a fairly advanced stage of execution.
(2.) ALL the issues in the present writ petition being fully covered by the judgment of this court in Gautam Estates Pvt. Ltd. (supra) as admitted by petitioner's counsel, this writ petition challenging the acquisition proceedings qua the petitioner's land under the provisions of the Land Acquisition Act, 1894 deserves dismissal.
(3.) WITH the above observations, the writ petition is dismissed. Stay application also stands dismissed.
