JUDGEMENT

(1.) HEARD learned counsels for the parties.

(2.) BY the instant second appeal appeal, the appellants- plaintiffs have called in question the judgment and decree dated 09.04.2010 passed by learned Additional District Judge, Sojat in Civil Appeal (Decree) No.4/08- Khinva Ram & Ors. Vs. Nagar Palika, Sojat & Anr. whereby the learned lower appellate court has dismissed the appeal and affirmed the judgment and decree dated 24.03.2008 passed by learned Civil Judge (Jr. Division) Sojat City in Civil Original Suit No.30/98-LR's of Mohan Lal Vs. Nagar Palika, Sojat & Anr. dismissing the plaintiffs' suit. 2. Both the courts below have concurrently refused to grant injunction in favour of plaintiffs-appellants as the plaintiffs claimed injunction without claiming relief of declaration.
