(1.) A letter sent by Shyam Kumar Vaishnav, a convicted prisoner of Central Jail Bikaner, has been treated as a letter petition. Mr. JDS Bhati has appeared on behalf of the petitioner.
(2.) Mr. Bhati has submitted that out of a total sentence of ten years, the petitioner has already served eight years, eleven months and seven days. Although he is eligible to be released on parole for twenty days, his case is not being considered by the Director General (Prisons), Jaipur.
(3.) On the other hand, the learned Public Prosecutor has submitted that while the reports of the Superintendent of Police Baran and Nacotics Control Bureau, Jodhpur have been received, reports of the Superintendent, Central Jail2 Bikaner and the report of Social Welfare Officer is yet to be received. In absence of these two reports, the case of the petitioner is still pending before the Director General (Prisons). He informs this court as soon as the reports are received, his case shall be considered by the DGP.
