(1.) Heard the learned counsel for the petitioner as well as learned Public Prosecutor.

The complainant-injured has filed this Revision Petition against judgment dated 27 th April 2006 passed by learned Additional Chief Judicial Magistrate, Sojat, District- Pali, whereby learned Chief Judicial Magistrate has acquitted the accused-respondents- Mangla Ram, Chandra Ram and Javri Lal for offences punishable under secs.341, 323, 325 read with sec.34 IPC.

Briefly stated facts of the prosecution case are that Police recorded a parcha-bayan (Ex.P18) by Mishri Lal (since deceased) on 04.12.1999 at 1:15AM, on the basis of which FIR (Ex.P19) was registered. According to the parchabayan, Mishri Lal along with his son Jetha Ram (PW5) went to house of accused Mangla Ram and scolded him that his son (Jetha Ram) is asked to drink daily by him (Mangla Ram). It is alleged that Mangla Ram was enraged by this and while them came outside his house, the three accusedrespondents gave beating to both father and the son, who sustained serious and grievous injuries.
