(1.) The State is aggrieved by the judgment dated 24.10.2007 passed by the District & Sessions Judge, Jaisalmer whereby the learned Judge has acquitted the accused-respondent, Shravan Ram, for offences under Sections 363, 366 IPC.

Briefly, the facts of the case are that on 24.04.2007, Sher Mohd., submitted a written report at Police Station Nokh wherein he claimed that on 23.04.2007, his daughter, Jainab, had gone out to fetch water from the canal. However, ever since then, she has not come back home. He has learnt that the accusedrespondent, Sharvan Ram, had come in a car and had taken his daughter with the intention of either marrying her himself, or to marry her of to another person. He further claimed that Shravan Ram used to work on the field of Karnaram Vishnoi. The said field is adjacent to the field belonging to the complainant's brother-in-law, Hakim Khan. However, he had left the job after few months earlier. On the basis of the said report, a formal FIR was chalked out for offences under Sections 363 and 366 IPC.
(3.) During the course of investigation, the accusedrespondent and the prosecutrix were recovered from Ramsinghpur in District Ganganagar.
