JUDGEMENT

(1.) The present bail application has been filed under Sec. 439 Crimial P.C. The petitioner has been arrested in connection with F.I.R. No. 343/2007, registered at Police Station Kushalgarh, Distt. Banswara for the offences under Sections 450, 395 and 397 I.P.C.

(2.) Learned counsel for the petitioner submits that in this case, the petitioner has been arrested after three years of the occurrence and the similarly situated co-accused namely Rawa has already been granted bail and the case of the present accused-petitioner is not distinguishable from that of co-accused Rawa, as such, the present petitioner deserves to be granted bail.

(3.) Per contra, learned Public Prosecutor has opposed the bail application.
