JUDGEMENT

(1.) THOUGH no application seeking condonation of delay has been filed but, having regard to the circumstances of the case, delay of 68 days in filing this review petition is ignored.

(2.) HOWEVER , after having heard the learned counsel for the petitioner and having perused the material placed on record, we are unable to find even a wee bit of reason to entertain this review petition, filed in relation to the order dated 23.01.2012 as passed by a Division Bench of this Court in D.B. Civil Special Appeal (W) No. 06/2012 whereby the intra-court appeal filed against the order dated 20.09.2011 as passed by a learned Single Judge of this Court in S.B. Civil Writ Petition No. 10441/2010 was dismissed after finding it to be an entirely baseless and rather frivolous a matter.

THE contentions were reiterated on behalf of the petitioner- appellant before a co-ordinate Bench in the intra-court appeal (SAW No. 6/2012) filed against the order so passed by the learned Single Judge. In its order dated 23.01.2012, the Division Bench considered all the relevant aspects of the matter and found that the reliefs as claimed by the petitioner-association were not available to be granted in the writ jurisdiction under Article 226 of the Constitution of India; and further observed that the Court cannot be converted into an appellate policy maker, over and above the State policy makers. The co-ordinate Bench proceeded to observe, inter alia, as under:-
