JUDGEMENT

(1.) The intra court appeal is time barred by 312 days and an application under Section 5 of the Limitation Act has been filed.

(2.) For the reasons stated in the application under Section 5 of the Limitation Act, the same is allowed and the delay in filing the appeal is condoned.

(3.) This intra court appeal has been preferred as against the order of the Single Bench dated 19.2.2009 dismissing C. W. P. No.1161/2002.
