JUDGEMENT

(1.) Mr. Sawai Lal, has sent a letter to this Court which has been treated as a letter petition. The petitioner is aggrieved by the fact that although he was eligible for grant of permanent parole, the same has not been granted to him.

(2.) The State has filed a reply wherein it has pleaded that the petitioner s case for grant of permanent parole was considered on 6.6.2011. However, as the petitioner had returned back from his third parole on 31.8.2010, therefore, he was not eligible to be granted the benefit of permanent parole on 6.6.2011. For according to the Rajasthan Prisoner (Release on Parole) Rules, 1958 there has to be a gap of eleven months between the grant of two paroles. Therefore, on 6.6.11, the gap of eleven months was not over. Hence, his case was rejected by the State Level Parole Advisory Committee.
