JUDGEMENT

(1.) THE learned counsel for the parties make a mention and submit that the matter could be disposed of with granting of some extra time to the petitioner-tenant to vacate the premises in question on the terms of payment of enhanced amount towards mesne profits.

THE petitioner-tenant has preferred this writ petition against the judgment and order dated 15.09.2012 as passed in Appeal No.10/2008 whereby the Appellate Rent Tribunal, Jodhpur, has affirmed the judgment and order dated 19.09.2007 as passed in Original Petition No.549/2004 whereby the Rent Tribunal, Jodhpur issued the certificate for recovery of possession while allowing the petition for eviction filed by the respondent-landlord.

(3.) IT is submitted that the petitioner shall require some extra time to make alternative arrangements for residence and, therefore, he may be granted some extra time to vacate the premises. The learned counsel for the petitioner submits that the petitioner shall be ready to make payment of the enhanced amount towards mesne profits particularly during the period he would be retaining the premises in question upon granting indulgence by this Court; and in regard to these submissions, an affidavit of the petitioner is being filed, copy whereof has been given to the counsel for the respondent.
