JUDGEMENT

(1.) BY this petition for writ, the petitioner is questioning initiation of disciplinary proceedings against him under the memorandum dated 9.3.2009 issued by the disciplinary authority as per Rule 16 of the Rajasthan Civil Services (Classification, Control & Appeal) Rules, 1958 (for short 'the Rules of 1958' hereinafter).

IN brief, the factual matrix of the case is that the Additional Chief Engineer, Indira Gandhi Nahar Pariyojana, Bikaner under a letter dated 9.7.2004 sought an explanation from the petitioner as to why disciplinary proceedings under Rule 16 of the Rules of 1958 be not initiated against him on the count that on 11.12.1992 while taking-over charge pertaining to Burji No.996 (Left) no Coal was available at the furnace concerned, but at a subsequent stage some interpolation was made in the Government record and just with a view to provide additional benefit to a contractor availability of 69.20 M.T.D. Grade coal was shown.
