GORDHAN Vs. STATE OF RAJASTHAN & ORS

JUDGEMENT

(1.) A letter has been received from Gordhan Ram, a convicted prisoner, of central Jail, Jodhpur, wherein he had prayed that he permitted to be released on first parole on his personal bond rather than required two personal sureties of Rs.15,000/- each.

(2.) Vide order dated 09.01.2012, this Court appointed Mr. Manish Tak as amicus curiae.

(3.) On the other hand, the learned Public Prosecutor has contended that according to Rule 7 of the Rajasthan Prisoners (Release on Parole) Rules, a prisoner cannot be released only his personal bond. Two sureties are equally required.
