JUDGEMENT

(1.) HEARD learned counsel for the appellant- defendant.

(2.) THE present appeal is directed against the judgment and decree dtd. 18.08.2010 passed by the learned District Judge, Chittorgarh in appeal No.35/2010 � Moti Ram vs. Devkaran by which the learned District Judge, Chittorgarh dismissed the appeal and upheld the judgment and decree dtd.23.05.2009 passed by the Civil Judge (Jr.Division), Gangrar, Chittorgarh in Civil Original Suit No.9/2003 � Devkaran vs. Motiram, whereby the learned trial Court decreed the suit for permanent injunction filed by the respondent-plaintiff and directed the appellant- defendant to close the "Naalde", windows and ventilators, which are opening towards the western side of plot of the respondent-plaintiff situated at Gangrar, within a period of four months at his own cost .
