(1.) Heard learned counsel for the parties and perused the judgments impugned passed by the Rent Tribunal, Jodhpur as well as Appellate Rent Tribunal, Jodhpur.
(2.) In the facts and circumstances of the case, I am not inclined to interfere in the concurrent finding of fact arrived at by the Courts below. Hence, this writ petition is dismissed.
(3.) However, counsel appearing on behalf of the petitioner submits that for vacating the premises in question, time may be granted to the petitioner. Learned counsel appearing on behalf of the respondent submits that he has no objection if time is granted but the time to be granted should be reasonable because decree has been passed in favour of the respondent by the Rent Tribunal, Jodhpur in the application filed in the year 2004 and the same is affirmed by the Appellate Rent Tribunal vide judgment dated 09.12.2011.
