JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) THIS intra Court appeal is directed against order dated 12th September, 2006 passed by the Single Bench, whereby S.B. Civil Writ Petition No. 5917/2003, filed by the petitioner/appellant, has been dismissed on the ground of delay/laches.

(3.) SUBMISSION of learned counsel for the appellants is that point involved in the present case has been decided in other cases by this Court in favour of the appellants therein, therefore, present matter should have been considered and decided on merits instead of dismissing the writ petition on the ground of delay.
