(1.) This intra court appeal has been preferred as against the order of the Single Bench dated 28.2.2012 dismissing C. W. P. No.11576/2011.

Briefly stated the facts of the case as alleged by the appellant/petitioner are that 6.14 bigha command land was allotted to Harnek Singh respondent no. 4 and Khatedari Sanad was also issued in his favour on 29.11.1988. It is alleged that respondent no. 4 entered into an agreement for sale of the land with the petitioner for a consideration of Rs. 40,000/- on 8.5.1992. The respondent no. 4 filed a suit under Section 183 and 88 of the Rajasthan Tenancy Act which came to be dismissed on 30.1.1999. The appeal preferred by respondent no. 4 before the Revenue Appellate Authority was allowed and the matter was remanded to the S.D.O. who after remand decreed the suit. Being dissatisfied with the order passed by S.D.O., the appellant preferred appeal before the R.A.A. which was dismissed and the second appeal filed before the Board of Revenue also came to be dismissed. The appellant preferred a writ application challenging these judgments.
(3.) The learned Single Judge after hearing the arguments of the learned counsel for the parties and considering the material available on record, dismissed the writ application vide order dated 28.2.2012.
