ASHA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) AFTER having heard the learned counsel for the petitioner- appellant and having perused the material placed on record, we are unable to find any reason to consider interference in this intra-court appeal against the order dated 18.7.2012 as passed in CWP No.7315/2012 whereby the learned Single Judge of this Court has declined to exercise writ jurisdiction as sought to be invoked by the petitioner-appellant, who is working on the post of Medical Officer, against an order of transfer.

(2.) THE learned Single Judge has essentially observed that the petitioner had already filed an appeal before the Rajasthan Civil Services Appellate Tribunal and was not entitled to prosecute two remedies simultaneously. We respectfully concur with the observations so made.
