JUDGEMENT

(1.) THIS fourth bail application has been filed by the present petitioner stating therein that similarly situated co-accused Mehram has been released on bail. There is no allegation against the present petitioner that he has committed rape. He has not been named in the FIR. The prosecutrix Sushila in her statement has specifically stated that the present petitioner is not known to her. He has not taken the prosecutrix forcibly and did nothing with the prosecutrix. The father of the prosecutrix Kishna Ram has also not alleged allegation of rape against the present petitioner. Hence he should be released on bail.

(2.) THE learned public prosecutor has opposed the bail application.
