JUDGEMENT

(1.) AT the request of learned counsel for the parties, the arguments have been heard finally and the writ petition is being disposed of.

(2.) THE petitioner has challenged the order of Central Administrative Tribunal, Jaipur Bench, Jaipur dated 22.4.2009, whereby his Original Application No.300 of 2006 has been dismissed.

(3.) THE respondents filed reply to the Original Application wherein, apart from preliminary objection regarding the maintainability of Original Application on the ground of limitation, it was also stated that a Circular dated 22.2.2006 has been issued by the Government of India, Ministry of Human Resource Development, Department of Secondary and Higher Education, wherein it has been specifically mentioned that the services rendered in a Public Sector Undertaking and or in a Private Institution will not be counted for the purpose of pension.
