KAILASH CHAND Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application under section 439 Cr.RC. has been filed on behalf of petitioner Kailash Chand against whom trial is pending in the court of ACJM, Mount Abu for the offence under section 4/25 of the Arms Act wherein the allegation against the petitioner is that swords, daggers, etc. have been found in his shop without any valid licence.

(2.) Having heard learned counsel for the petitioner and learned public prosecutor on behalf of the State and upon a perusal of the police papers placed before me and looking to all the facts and circumstances of the case as also to nature of alleged offence, i deem it just and proper to enlarge the petitioner on bail.

(3.) In the result, the bail application under section 439 Crimial P.C. is allowed and it is directed that petitioner Kailash Chand be released on bail on his furnishing a personal bond in the sum of Rs. 50,000.00 with two sureties each in the sum of Rs. 25,000.00 to the satisfaction of the concerned court for his appearance on each and every dated of hearing before that court until conclusion of the trial.
