JUDGEMENT

(1.) An application has been moved for correction in the bail order to the extent that instead of FIR No. 186/91 of Police Station Gandhi Nagar, Jaipur, it should be mentioned as FIR No. 176/91 of Police Station, Ashok Nagar.

(2.) The contention of the learned counsel is that initially the FIR had been lodged at Police Station. Gandhi Nagar where it was registered as 186/91 on 14-4-91 and they registered the case for offence under Sec. 379 IPC. During the course of investigation, the same FIR was transferred to Police Station, Ashok Nagar where this was registered as FIR No. 176/91. Thus, the case is the same in which the petitioner had been granted bail vide order dated 17-7-91.

(3.) I have seen the photostat copy of the FIR which had been filed at Police Station, Gandhi Nagar and the subsequent FIR which had been filed at Police Station Ashok Nagar. The transfer of the case during the course of investigation does not require a separate order to be passed. Police Officer must know that it is the case in which the bail has been granted. The order passed by the learned Sessions Judge, Jaipur City. Jaipur also gave the number of the case as 126/91 of Police Station Gandhi Nagar, Jaipur, on 26-6-91.
