JUDGEMENT

(1.) The instant misc. petition has been preferred by the petitioner seeking quashing of the FIR No.31/2016, registered at the Police Station Banar, District Jodhpur.

(2.) Learned Public Prosecutor has placed on record the factual report as per which, the Investigating Officer found that the FIR was filed without jurisdiction and accordingly, a negative final report was submitted in the court concerned which has been accepted and the transfer of the case is being sought to the appropriate jurisdiction.

(3.) In this view of the matter, nothing survives for consideration of this Court in this misc. petition which is dismissed as having rendered infructuous. The stay application is also disposed of.
