KALU RAM SAINI Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.99/2021 Registered at Police Station Vaishali Nagar, Jaipur for the offence(s) under Sections 457 and 380 of IPC.

(2.) Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter and the case is triable by First Class Magistrate and the recovery has already been effected. Counsel further submits that co-accused persons have already been released on bail by this Court and no other criminal case is pending against the accused-petitioner and the challan has already been presented in the Court. Counsel further submits that the challan has already been presented in the Court and due to ongoing COVID-19 problem, the trial is not proceeding.

(3.) Learned Public Prosecutor assisted by counsel for the complainant has opposed the bail application.
