RAMPARVESH SINGH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This appeal is directed against the judgment and order dtd.27.4.2006 passed by the learned Special Judge, NDPS Cases, Jodhpur in Sessions Case No.31/2005 whereby the learned trial Court has convicted the appellant for offence under Section 8/20 of the NDPS Act and has sentenced him to 3 years' R.I. and a fine of Rs.25,000/-, in default of payment of fine to further undergo 6 months' R.I.

(2.) During the course of arguments, the learned counsel for the appellant submitted that the appellant is behind bars since 26.2.2005 and has already undergone the complete sentence awarded to him for the aforesaid offences, therefore, the present appeal has become infructuous and he does not press the same on merits.

(3.) The learned PP Ms. Chandra Lekha Parihar has verified this fact from the record of the case.
