JASWANT RAM Vs. STATE OF RAJ & ORS

JUDGEMENT

(1.) This second appeal under Section 100 of CPC has been filed by the appellant-plaintiff being aggrieved by the judgment and decree of learned first appellate court dated 22.02.2008 in Appeal No.19/2006 whereby he dismissed the appeal while affirming the judgment and decree of the learned trial court dated 10.10.2006 dismissing the suit No. 90/2001 filed by the plaintiff-appellant has been dismissed.

(2.) Learned counsel for the appellant-plaintiff submits that the appellant sought compassionate appointment, for which he filed writ petition before this Court being SBCWP No.3529/1998 (Jaswant Ram Vs. State & Ors.), however, said writ petition was dismissed by this Court vide order dated 18.03.1999.

(3.) Since, both the courts below have concurrently dismissed the suit filed by the appellant-plaintiff, therefore, this Court is of the opinion that no interference is called for in the judgment anddecree of first appellate court upholding the judgment and decree passed by learned trial court. In considered opinion of this Court, no substantial question of law arises in the present second appeal.
