JUDGEMENT

(1.) Learned counsel Mr. Vipul Singhvi is appointed as Amicus Curiae in the present appeal as Mr. S.P.Bhati earlier appearing in the matter on behalf of the appellant has now become Assistant Public Prosecutor.

(2.) Heard learned counsel for the appellant and learned Public Prosecutor for the State.

(3.) This appeal is directed against the order dated 18/12/2004 passed by the learned Special Judge (SC & ST Prevention of Atrocities) Cases, Merta, whereby, learned court below convicted the accused appellant for the offence under Sections 452 and 307 IPC and sentenced him to undergo three years SI and fine of Rs.500/- and in default of payment of fine to further undergo one month's SI for the offence under Section 452 IPC and seven years RI and fine of Rs.500/- and in default of payment of fine to further undergo one month SI for the offence under Section 307 IPC.
