BABU LAL Vs. UNION OF INDIA AND ORS

Decided On May 20, 2011
BABU LAL Appellant
V/S
Union of India And Ors Respondents

JUDGEMENT

(1.) The learned counsel for the respondents submitted that the petitioner; a casual civilian labourer claimed regularization in the services of Air Force and in this regard, he had approached the Central Administrative Tribunal, Jodhpur Bench, Jodhpur by way of OA No.182/1994, which came to be rejected on 12.7.1996 against which he preferred a writ petition before the Division Bench of this Court , which also appears to have been withdrawn on 10.10.2000 vide Annex.2. Thereafter the petitioner again sought reference from the Central Government to the Industrial Tribunal for allegedly raising the same as industrial dispute, which has come to be rejected vide impugned order dtd.7.5.2002 (Annex.3) on the same ground that the dispute has already been adjudicated by the Central Administrative Tribunal, Jodhpur Bench, Jodhpur while dismissing the OA No.184/1994. This writ petition is directed against the order dtd.7.5.2002 (Annex.3).

(2.) Having heard the learned counsels and considering the submissions made at the Bar, this Court is of the opinion that no ground to interfere in the matter now at this stage after the same having been adjudicated time and again before the Central Administrative Tribunal, Jodhpur Bench, Jodhpur and the Division Bench of this Court and the reference to the Industrial Tribunal having been turned down by the Central Government.

(3.) The writ petition is therefore, found to be devoid of merit and the same is accordingly dismissed. No order as to costs.
