JUDGEMENT

(1.) HEARD learned Counsel for the Applicant and the learned Public Prosecutor and perused the Challan papers.

(2.) LEARNED Counsel for the Applicant submits that as per statements of the prosecutrix, the allegation of committing rape are against the co -accused, namely, Shravan; whereas the Petitioner is said to be simply standing nearby and he took no active part in the act of rape.

(3.) LOOKING to the the submissions advanced by the learned Counsel for the Applicant at bar and particularly the fact that allegation of rape is against the co -accused Shravan, this Court is inclined to release the Petitioner on bail.
