JAIN CONSTRUCTION COMPANY Vs. UNION OF INDIA

JUDGEMENT

(1.) BY this application under Sec.10 and 11 of the Arbitration and Conciliation Act, 1996, the Applicant has prayed for appointment of independent Arbitral Tribunal.

(2.) ON 31.8.2004, an agreement containing arbitration Clause 64 was entered into between the parties, which is not in dispute in this case.

(3.) COUNSEL for both the parties submit that there is no dispute about the territorial jurisdiction and further, the applicant and the non-applicants are parties to the agreement and the General Conditions of Contract are applicable.
