JUDGEMENT

(1.) This writ petition has been filed by the petitionerdefendant (Tenant) being aggrieved by the order dated 15.01.2008 passed by the learned Additional District Judge, No.2, Bhilwara whereby while granting stay in appeal, the learned court below determined interim/provisional rent @ Rs.3000/- per month during the pendency of the appeal.

(2.) However, since the learned lower appellate court itself has dismissed the appeal filed by the petitioner-defendant and against the judgment and decree passed by the learned courts below, the second appeal being SBCSA No.64/2010 (Amba Lal Vs. LR's of Mishri Lal & Ors.) preferred by the petitioner-defendant has also been dismissed by this Court vide judgment dated 03.08.2011, therefore, in view of judgment rendered in the second appeal filed by the petitioner, the present writ petition also deserves to be dismissed.

(3.) Accordingly, the present writ petition is dismissed. No costs.
